Impartiality in Rittenhouse Murder Trial Sorely Lacking

INTEGRITY is SORELY LACKING in the highly visible court case of accused murderer Kyle Rittenhouse. The judge in the case is seemingly bold, brazen, and biased, demonstrating judicial favoritism towards the defendant Rittenhouse. Or maybe I’m just uber-sensitive because of the many mishandled court cases by judges behaving badly.
One particular night in 2020, Kyle Rittenhouse (then 17 years old) was out beyond a mandated curfew in a city and state at least 21 miles from his home. He was an underage minor illegally armed with an assault rifle, and he intentionally shot and killed two protesters at a rally against police brutality in Kenosha, Wisconsin. He had no legal reason to be there, especially illegally armed with an assault rifle.
The judge in the Rittenhouse case is Kenosha County Circuit Judge Bruce Schroeder. During the trial, Schroeder ordered that the two men Kyle murdered cannot be referred to as “victims” – but he ordered that the protesters participating in the rally against police brutality can be referred to as “rioters” and “looters.”
To most reasonable people, it seems Schroeder obviously has a bias, his actions are not impartial. There is no logical reason for throwing out the underage gun charge in Kyle’s case. Why not let all the charges play out in court?
One of Philadelphia’s most prominent/award-winning criminal defense attorneys Michael Coard weighed in on the dismissed gun charge in the Rittenhouse trial on his Instagram page. Coard said the gun charge was “dismissed only because it pertains to short-barrel guns under 12 inches. (Kyle’s gun) was 16.”
According to Coard, Rittenhouse still faces the following charges:
“Intentional Homicide, Any Dangerous Weapon.” (Life sentence)
“Attempted Intentional Homicide, Any Dangerous Weapon” (Up to 65 years in prison)
“Reckless Homicide, Any Dangerous Weapon.” (Up to 65 years in prison)
“Reckless Endangerment, Any Dangerous Weapon” (2 counts – up to 35 years in prison)
“In the past dozen years, state and local judges have repeatedly escaped public accountability for misdeeds that have victimized thousands,” reports Reuters news service.
In 2020, Reuters cited cases of immoral, unlawful, and egregious biased judges, including an “Alabama judge who unlawfully jailed hundreds of poor people, many of them Black, over traffic fines.”
For example, according to Reuters, “Judge Les Hayes once sentenced a single mother to 496 days behind bars for failing to pay traffic tickets. The sentence was so stiff it exceeded the jail time Alabama allows for negligent homicide.”
Schroeder’s court instructions and heavy-handed influence in the Rittenhouse case have swayed the case in favor of Rittenhouse. He has thrown impartiality out the window. This type of injustice and courtroom shenanigans has incensed civil rights activists for generations!
“Judges have made racist statements, lied to state officials, and forced defendants to languish in jail without a lawyer…In the first comprehensive accounting of judicial misconduct nationally, Reuters identified and reviewed 1,509 cases from the last dozen years – 2008 through 2019 – in which judges resigned, retired, or were publicly disciplined following accusations of misconduct…9 of every 10 judges were allowed to return to the bench after they were sanctioned for misconduct, Reuters determined.”
U.S.Courts.gov reported that “The number of complaints (against judges) filed in 2018 was 1,348, an increase of 70 complaints (up 5 percent) from the number filed in 2017…The categories of allegations associated with the most complaints were erroneous decision (1,120), other misconduct (415), personal bias against the litigant or attorney (285), and violation of other standards (151).”
America’s justice system needs to be impartial and full of integrity, otherwise, our courts become a sham. A charade. A farce. A lynching masquerading as justice. Our courts and court officials need to practice fair, balanced, and legal justice. Not misconduct that promotes white privilege.
As it relates to the Kyle Rittenhouse trial, some would say the fix is in. The world waits with bated breath for the verdict outcome of this peculiarly handled trial.
